A grand jury indictment was filed on March 7, 1974, charging defendant with five counts*fn3 of rape in the second degree. The alleged rapes occurred on December 26 of 1973 and January 21, 25, 26 and 27 of 1974. The victims of the alleged rapes were five sisters whose ages ranged from 13 to 20 years. Defendant, the common-law husband of the victims' mother, pled not guilty to each count. A jury found defendant guilty on three of the counts but hung as to the other two counts.
