The first and second exceptions are based upon the failure of the trial court to exclude the testimony of Grover Bentley, the taxicab driver, in which he testified to certain threats and statements made by the defendant. This witness merely related what took place during the defendant's efforts to evade arrest after killing the police officer, which included threats made against the taxicab driver if he did not assist the defendant in escaping. These exceptions cannot be sustained. S. v. Payne, 213 N.C. 719, 197 S.E. 573; S. v. Steele, 190 N.C. 506, 130 S.E. 308. Moreover, the defendant, without objection, testified to substantially the same facts as those testified to by the witness Bentley, to which the defendant directs his exceptions. S. v.
